79 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE <br />SURPLUS WATER FROM THE CITY OF SUFFOLK DURING A DROUGHT- <br />CAUSED EMERGENCY; TO SELL WATER TO SUFFOLK UNDER SIMILAR <br />CONDITIONS. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia~ <br />adopted an Ordinance on August 12, 1980 declaring that ~/qere <br />exists an immediate potential for a shortage of potable water <br />in its water supply and authorizing the City Manager to commence <br />conservation measures to prevent a crucial water shortage as <br />a result of climatic, hydrological and other extraordinary <br />natural conditions; and <br /> <br /> I,~EREAS, Suffolk owns and operates a water supply and <br />distribution system which includes deep water wells located <br />within the corporate limits of Suffolk; and <br /> <br /> ~EP~AS, the Suffolk water system has an abundance of <br />potable drinking water which it can deliver directly into <br />the Portsmouth lakes located within the corporate limits <br />of Suffolk; and <br /> <br /> WHEREAS, during conditions of shortages of potable water, <br />it is mutually beneficial to both cities to facilftate the <br />conx~eyance of wa%er from one system to the other system. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth: <br /> <br /> 1, That the City Council does hereby authorize the <br />City Manager to enter into an agreement with the City of <br />Suffolk to purchase surplus water as needed by.Portsmouth <br />during the present drought-caused emergency and during <br />future emergencies resulting from similar natural conditions. <br />under mutually agreeable ~erms and conditions and to agree <br />to sell to Suffolk, if the need arises during any future <br />emergency resulting from similar natural conditions, such <br />surplus water needed by Suffolk pursuant to the same terms <br />and conditions. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he <br />hereby is, authorized to execute such agreements and other <br />documents as may be necessary to complete this transaction. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held September 23, 1980. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
