69 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO WARREN L. HOLLAND, SR. <br />TO CONSTRUCT ~-ND OPERATE A CONVALESCENT OR NURSING HO~E ON <br />PROPERTY ON POWHATAN AVENUE. <br /> <br /> WHEREAS, Warren L. Holland, Sr., owner of certain <br />hereinafter described property, pursuant to Section 40-75(b) <br />of the Code of the City of Portsmouth, Virginla, 1973, has <br />petitioned for the granting of a use permit as hereinafter <br />described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; Mud <br /> WHEREAS, the Planning Commission has recommended the <br /> granting of said use permit. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br /> City of Portsmouth, Virginia: <br /> <br /> !. That the use for which the permit is sought for <br /> the construction and operation of a convalescent or nursing <br /> home: <br /> <br /> (a) Will not adversely affect the health and <br /> safety of oersons residing or working in the neighborhood <br /> of the proposed use; <br /> <br /> lb) Will not be detrimental to the public use or <br /> injurious to property or 'improvements in the nemghborhood; <br /> and <br /> <br /> lc) will be in accord with the purposes of the <br />. Zoning Chapter of the City Code. <br /> 2. Warren L. Holland, Sr. is hereby granted a use oermit <br /> pursuant to Section 40-75 ~) of the Code of the City of Ports- <br /> mouth, Virginia, 1973, to construct and ooerate a convalescent <br /> or nursing home on propertyde~cribed as ~ollows: <br /> Beginning at a point on the west side <br /> of Powhatan Avenue, said ooint being 216.10 <br /> feet south from the 'inter~ection of Powhatan <br /> Avenue and Griffin Streets; thence south <br /> along Powhatan Avenue 60 feet; thence west <br /> 505 feet, more or less; thence northwest 145 <br /> feet, more or less; thence north 10 feet, <br /> more or less, to the property now or formerly <br /> owned by Seaboard Coast Line Railroad Company; <br /> thence northeast along the said Seaboard Coast <br /> Line Railroad property 480 feet; thence south <br /> 125 feet, more or less, thence southeast 85 <br /> feet, more or less; thence east 5 feet, more <br /> or less; thence south 20 feet, more or less; <br /> thence east 90 feet to the west right of way <br /> of Powhatan Avenue, the Point of Beginning.- <br /> <br /> <br />
