68 <br /> <br />A RESOLUTION GRANTING k USE PERMIT TO FLOURS INDUSTRIES, <br />SWEETBRIER DEVELOPMENT COMPANY AND CONTINENTAL REAL ESTATE <br />COMPANY TO CONSTRUCT AND OPERATE A WHOLESALE BAKERY PRODUCTS <br />DISTRIBUTION WAREHOUSE ON EL~HURST LANE. <br /> <br /> WHEREAS, Flours Industries, Sweetbrier Development <br />Company and Continental Real Estate Company, pursuant to <br />Section 40-71(b) of the Code of the City of Portsmouth, <br />Virginia, 1973, have petitioned for the granting of a use <br />permit as hereinafter-described; and <br /> <br /> ~97{EREAS, the applicant and the Planning Director have <br />done al! things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit is hereinafter <br /> sough%: <br /> <br /> Ca) will not adversely affect the health and <br /> safety of persons residing or working in the neighborhood <br /> of the proposed use; <br /> <br /> ~b) Will not be detri, mental to publ±c use or <br /> injurious to property or improvements in the neighborhood; <br /> and <br /> <br /> Cc) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Flours Industries, Sweetbrier Deve!op~ent Company <br />and Continental Real Estate CoI~pany are hereby granted a ~se <br />permit pursuant to Se6tion ~O~71~) of the Code of the City <br />of Portsmouth, Virginia, 1973, to operate a wholesale bakery <br />products distribution warehouse on property described as <br />follows: <br /> <br /> Beginning at the northeast corner of <br />Airline Boulevard and Elmhurst Lane; thence <br />easterly along the north right of way of <br />Airline Boulevard 250 feet; thence northerly <br />511.89 feet; 'thence north westerly 73.03 feet; <br />thence westerly 14.97 feet~ thence south- <br />westerly 207.56 feet to the east right of <br />way line 'of El~hurst Lane; thence soutb~erly <br />481.27 feet to the Point of Beginning. <br /> <br /> <br />
