~6 A RESOLUTION AUTHORIZING THE SALE OF AN EASEMENT TO THE CITY OF NORFOLK, VIRGINIA, FOR THE NORFOLK WATER LINES LOCATED IN THE FO~4ER RIGHT-OF-WAY OF SEABOARD COAST LINE RAILROAD COMPANY PROPERTY. WHEREAS, %he City of Portsmouth has purchased from the Seaboard Coast Line Railroad CCnnpany the abandoned right- of-way extending across the City of Portsmouth from the western branch of the Elizabeth River to Mt. Vernon Avenue; and WHEREAS, there is located within this property a City of Norfolk water main which was installed pursuant to an agreement between the City'of Norfolk and.the Railroad; and WHF~REAS, the City of Norfolk, in order to retain the use of said property for its water lines has agreed to pur- chase the hereinafter-described easement_from the City of Portsmouth for the agreed appraised value of Forty Thousand, Eight Hundred Eighty Dollars [$40,880.]; and WHEREAS, the conveyance of the hereinafter-described easement will not adversely affect the use 'of the property or disposition thereof by'the 'City of Portsmouth; and WkLEREAS, Section ~.09 ~ of the Charter of the City of Portsmouth provides that property may be conveyed to a political subdivision of the Commonwealth of'Virginia without advertisement 'and public notice; and WHEREAS, the 'City of Norfolk is a municipal corporation of the Co~auonwealth of Virgln±a. NOW, THEREFORE, BE IT RESOLVED by-the Council of the City of Portsmouth, Virginia, that a perpetual easement, privilege 'and r~ghh~of-waybe sold to the City of No~folk, Virginia, for operation', installation and maintenance of a water line or lines over, under and across'the hereinafter- described property, to-~it: ~I1 that certain piece a-nd parcel of land situate,:~lying and being in the City of Portsmouth, ¥~rginia,-bounded and de- scribed as follows: Beginning at a point designated on the Seaboard Coast Line Railroad Company right-of-way and track Maps V. 3-VA/S,
