41 <br /> <br />A RE~OLUTION APPROVING A CONSERVATION PLAN FOR THE TRUXTUN <br />CONSERVATION DISTRICT. <br /> <br /> W~EREAS, under the provisions of the Eousing and Community <br />Development Act of 1974, as amended, financial assistance is <br />provided to localities for undertaking and carrying out <br />come. unity development activities, including the execution <br />of conservation projects; and <br /> <br /> WHEREAS, said conservation projects must be approved by <br />the governing body of the locality in which the project is <br />situated pursuant to Title 36 of the Code of Virginia, 1950, <br />as ~ended, and that such ap~oval-must~inctude f~ndings by <br />the governing body that: <br /> <br /> i. The Conservation Plan will afford maxim~ opportunity, <br />consistent with the sound needs of the locality as a whole, for <br />conservation of the pro3ect area by private and/or public en- <br />terprise; and <br /> <br /> 2. That Conservation Plan conforms to the general plan <br />for the development of the locality as a whole; and <br /> <br /> ~EREAS, a plan, identified as the Conservation Plan for <br />the Truxtun Conservation District (hereinafter referred to as <br />the "Plan"), dated June, 1981, and consisting of six pages and <br />two exhibits has been referred to this Council for review and <br />approval; and <br /> <br /> WHEREAS, the Plan for the conservation district identified <br />as the Truxtun Conservation District (hereinafter called the <br />"Project"), encompasses the area as described in the boundary <br />description within the Plan mn the City of Portsmouth, State <br />of Virginia ~ereinafter called the "Locality"), and delineated <br />on the attached exhibit; and <br /> <br /> WHEREAS, a study of the project area has been made and <br />has been determined that the area is deteriorating and <br />eligible for conservation pursuant to Title 36 of the Code <br />of Virginia; and <br /> <br />it <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing-Authority <br />has resolved that this Plan is in the best interest of the <br />City's renewal effort; and <br /> <br /> WHEREAS, this Council is cognizant of the conditions that <br />are imposed by the provms!ons of the Housing and Community <br />Development Act of 1974, as smended, including those prohibiting <br />discrimination on the basis of race, age, color, creed, sex or <br />national origin; and <br /> <br /> <br />
