32 A RESOLUTION AUTHORIZING GARBAGE DISPOSAL COMPANIES TO DEPOSIT IN THE CITY INCINERATOR ON AN EMERGENCY BASIS AND UPON SUCH CONDITIONS AS THE CITY MANAGER MAY DIRECT GARBAGE COLLECTED FROM SHIPS AHCHORED IN THE CHESAPEAKE BAY AREA. WHEREAS, the Governor of Virginia has initia~ed action to correct the health problems caused by ships at anchorage dumping garbage in the Chesapeake Bay area; and WHEREAS, various garbage disposal companies have contracted with agents representing the ships to collect such garbage; and WHEREAS, said garbage disposal companies have obtained approval of the U.S. Department of Agriculture for the proper handling and inspection of said materials; and ~EREAS, said garbage disposal companies have requested authority to deposit said materials in the City of Portsmouth Incinerator; and WHEREAS, Section 14-6 of the Code of the City of Portsmouth prohibits the deposit of garbage or refuse at the City incinerator which garbag~ or refuse was generated outside of the corporate limits of the City of Portsmouth; and ~qEREAS, %he Council of the City of an emergency situation exists in regards materials. Portsmouth deems that to disposal of said NOW, THEREFORE, BE IT RESOLVED by the.~ouncil of the City of Portsmouth, Virginia~ that said garbage disposal companies be, and they hereby are, authorized to deposit in the City incinerator on an emergency basis and upon such conditions as may be directed by-the City Manager garbage collected from ships anchored'in the Chesapeake Bay area. BE IT FURTHER RESOLVED that this authority may be revoked by the City Manager upon failure of said garbage disposal companies to comply with said conditions or upon the termination of the emergency situation in the Chesapeake Bay area.
