25 <br /> <br />A RESOLUTION GPJ~TING A USE PERMIT TO THE PORTSMOUTH REDEVELOP~IENT <br />AND HOUSING AUTHORITYAND STOP ORGANIZATION TO CONSTRUCT AND <br />OPERATE A CONVALESCENT HOME ON PROPERTY BOUNDED BY LINCOLN STREET <br />ON THE NORTH, SIXTH STREET ON THE WEST, NELSON STREET ON THE <br />SOUTH AND FIFTH STREET ON THE EAST. . <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority <br />by Harvey N. Johnson, Jr., agent for the STOP Organization, <br />has made application pursuant to Section 40-75 (b) of the <br />Code of the City of Portsmouth, Virginia, as amended, for the <br />granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the pro- <br />posed use; <br /> <br /> (b) <br />injurious to <br />and <br /> <br /> Will not be detrimental to the public use or <br />the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Portsmouth Redevelopment And Housing Authority and <br />the STOP Organization are hereby granted a use permit pursuant <br />to Section 40-75(b) of the Code of the City of Portsmouth, <br />Virginia, to operate a convalescent home on property described <br />as follows: <br /> <br /> Beginning at the northwest corner of <br />Nelson and Fifth Street; thence north along <br />the west right-of-way of Fifth Street to the <br />south right-of-way of Lincoln Street; thence <br />west along said right-of-way to the east <br />right-of-way of Sixth Street; thence south <br />along said right-of-way to the north right- <br />of-way of Nelson Street; thence east along <br />said right-of-way to Fifth Street, the Point <br />of Beginning. <br /> <br /> <br />
