WHEREAS, said proposed legislation provides only for <br />the payment of a sum equivalent to the amount lawfully <br />assessed as real property tax if the property were privately <br />owned; a~d <br /> <br /> WHEP~JkS, said proposed legislation does not provide <br />for an orderly development of rail access to the subject <br />property in conjunction with traffic control requirements <br />and the environmental quality of life of the City of Portsmouth; <br />and <br /> <br /> ?~EREAS, said proposed legislation does not provide <br />for the submission to the City of Portsmouth of a site plan <br />of the proposed development of said property for review and <br />approval by the governing body of the City in accordance <br />with ~40-69~b) of the Zoning Code of the City of Portsmouth <br />and fo~ the orderly development of property within the <br />boundaries of the City of Portsmouth; and <br /> <br /> Wt{EREAS, said proposed legislation does not define <br />that portion of the 623 acre tract to be used for the coal <br />exporting facility, thereby precluding any attempt by the <br />City to participate in the development of the remainder <br />of the tract for industrial or port related purposes; and <br /> <br /> WHEREAS, the City of Portsmouth is Opposed to the taking <br />by the Virginia Port Authority of any portion of the subject <br />property not actually and specifically required for the <br />location ~nd construction of a coal exporting facility thereby <br />reducing the value of the remaining land for'development pur- <br />poses; and <br /> <br /> ~EREAS, other potential sites for a coal exporting facility <br />exist in the Hampton Roads area; and <br /> <br /> WHEREAS, the financial viability of the proposed development <br />and the ultimate long term necessity of the construction of <br />additional coal exporting capacity in Virginia has not been <br />established. <br /> <br /> NOW, THEREFORE., BE. IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the City Manager and the City Attorney be~ <br />and they hereby are, authorized to determine the appropriate <br />action necessary to insure the development of the 623 acres <br />site owned by Trails ~nd Land Company in a manner compatible <br />with development recuirements by private enterorise and to <br />the best interest of the City of Portsmouth and its residents; <br />to report such recommended action not later than March 10, 1981. <br /> <br /> 2. That the City Manager and the City Attorney be, <br />and they hereby are, authorized to consult immediately with <br />the Governor of Virginia and the Virginia Port Authority in <br /> <br /> <br />
