A RESOLUTION GRANTING A USE PERMIT TO EARL J. <br />OPERATE A JUNKYARD AT 700 YORKTOWN AVENUE. <br /> <br />COOK, SR. TO <br /> <br /> WHEREAS, Earl J. Cook, Sr., made an application pursuan~ <br />to ~40-69(b) of the Code of the City of Portsmouth, 1973, <br />for the granting of a use permit as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Dire6tor have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of.said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> t. That the use for which the use permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons residing or working in the neighborhood <br />of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use <br />or injurious to property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Earl J. Cook, Sr. <br />pursuant to §40-69(b) of the <br />on the property described as <br /> <br />is hereby granted a use permit <br />City Code to operate a junkyard <br />follows: <br /> <br />UP-81-17 <br /> <br /> Beginning on the east side of Yorktown <br />Avenue 121', more or less, south from its in- <br />tersection with County Street; thence south <br />151.88' to a point; thence northwest 283.24'; <br />thence southwest 29.72'; thence north 89.60'; <br />thence east 300' to the east right-of-way line <br />of Yorktown Avenue, the Point of Origin. <br /> <br /> 3. The following conditions are prescribed for this <br />use permit: <br /> <br /> <br />
