77 A RESOLUTION D2~ENDING A USE PERMIT GRANTED TO TIDEWATER BIBLEWAY TEMPLE TO OPERATE A CHURCH OR HOUSE OF WORSHIP AT 504-510 HIGH STREET. WHEREAS, the Council of the City of Portsmouth, Virginia, by Resolution adopted August 26, 1980, granted a use permit pursuant to Section 40-120(a) and Section 40-72(b) of the Code of the City of Portsmouth, Virginia, to operate a church or house of worshio on the property known as 504-510 High Street; and ~UHEREAS, the terms and conditions of said use permit in- structed the City Manager to advise the City Council on the status of the permit and to recommend such modification or ter~ination of the conditional use permit as may be deemed ap- propriate in the event that Tidewater Bibleway Temple fail to obtain permits for construction, alteration or renovation of the property not later than December 31, 1980; and W~HEREAS, due to circumstances beyond the control of Tidewater Bib!eway Temple, permits for exterior construction were not obtained within the time required by the use permit; and ~qEREAS, Tidewater Bibleway Temple have petitioned for the granting of an amendment to the use permit; and WHEREAS, the applicant and the done all things required to be done ~pplication; and Planning Director have mn connection with said ~%~EREAS, the Planning Commission has recommended that the use permit be amended. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: -. That the use for which the permit is sought and the amendment requested: of persons oosed use; (a) Will not adversely affect the health and safety residing or working in the neighborhood of the pro- (b) Will not be detrimental to the public use or injurious to property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chaoter of the City Code.
