77 <br /> <br />A RESOLUTION D2~ENDING A USE PERMIT GRANTED TO TIDEWATER BIBLEWAY <br />TEMPLE TO OPERATE A CHURCH OR HOUSE OF WORSHIP AT 504-510 HIGH <br />STREET. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />by Resolution adopted August 26, 1980, granted a use permit <br />pursuant to Section 40-120(a) and Section 40-72(b) of the <br />Code of the City of Portsmouth, Virginia, to operate a church <br />or house of worshio on the property known as 504-510 High <br />Street; and <br /> <br /> ~UHEREAS, the terms and conditions of said use permit in- <br />structed the City Manager to advise the City Council on the <br />status of the permit and to recommend such modification or <br />ter~ination of the conditional use permit as may be deemed ap- <br />propriate in the event that Tidewater Bibleway Temple fail <br />to obtain permits for construction, alteration or renovation <br />of the property not later than December 31, 1980; and <br /> <br /> W~HEREAS, due to circumstances beyond the control of <br />Tidewater Bib!eway Temple, permits for exterior construction <br />were not obtained within the time required by the use permit; <br />and <br /> <br /> ~qEREAS, Tidewater Bibleway Temple have petitioned for <br />the granting of an amendment to the use permit; and <br /> <br /> WHEREAS, the applicant and the <br />done all things required to be done <br />~pplication; and <br /> <br />Planning Director have <br />mn connection with said <br /> <br /> ~%~EREAS, the Planning Commission has recommended that the <br />use permit be amended. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> -. That the use for which the permit is sought and the <br />amendment requested: <br /> <br />of persons <br />oosed use; <br /> <br />(a) Will not adversely affect the health and safety <br />residing or working in the neighborhood of the pro- <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to property or improvements in the neighborhood; and <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br />Chaoter of the City Code. <br /> <br /> <br />
