being operated in connection with the operator's facility <br />during the peak vehicular traffic hours of 6:30 a.m. to <br />9:00 a.m. and 3:30 p.m. to 6:00 p.m. and such other times <br />as may be identified by the City as critical times unless <br />otherwise agreed to by the City or its designated representative. <br /> <br /> (16) The specifications for the construction, <br />operation, and maintenance of an industrial access roadway to be <br />built in accordance with City specifications which will provide <br />an entrance and exit for the port in such a way that traffic <br />will have access to the port without delays at railroad crossings <br />to the greatest extent possible. <br /> <br /> (17) The specifications for the installation, <br />operation and maintenance of hazard warning signals to be in- <br />stalled at key intersections, approved by the City of Portsmouth <br />or its designated representative in order to provide maximum <br />safety for railroad grade crossings. <br /> <br /> (18) The specifications for the installation, <br />operation and maintenance of a signaling system to be installed <br />at key locations, approved by the City of Portsmouth or its <br />designated representative, which will ale~t and reroute vehicular <br />traffic to available alternative routes in order to minimize <br />interference with vehicular traffic. <br /> <br /> (19) In no event will the operators be permitted <br />to commence operat±ons at the coal loading facility un%il the <br />plan has been approved by the City Council or its designated <br />representative. <br /> <br /> Cf) The operator shall be required to comply with <br />all statutes, ordinances, policies and regulations of federal, <br />state and local governments or agencies that may be applicabl~ <br />to the subject use, and shall obtain all necessary licenses <br />and permits required for this use by law. <br /> <br /> (g} Prior to commencement of any coal loading <br />operat£ons on the subject property, the operator shall provide <br />evidence of compliance with all applicable conditions noted <br />above to the City of Portsmouth or its designated representative. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held Septer~ber 8, 1981. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
