61 A RESOLUTION RELEASING A PORTION OF A T~NTY FOOT MAINTENANCE EASEMENT ALONG THE NORTH SIDE OF THE PORTSMOUTH SEAWALL; IN- STRUCTING THE CITY MANAGER TO EXECUTE A DEED OF RELEASE~ WHEREAS, by a plat recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in Map Book 11, Page 49, the Portsmouth Redevelopment And Housing Authority dedicated a twenty foot maintenance easement along the north side of the Portsmouth Seawall adjacent to "Parcel B" as shown on said plat for the purpose of maintaining the concrete Sea- wall; and ~KEREAS, a portion of said maintenance easement is now required for the construction of the Crawford Harbor Tower Apartment Project; and WHEREAS, said hereinafter-described portion of such easement is no longer required by th~ City of Portsmouth is hereby declared to be excess° and NOW, THEHEFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City of Portsmouth hereby releases any and all right, title or interest in and to the hereinafter-described portion of said twenty foot maintenance easement along the north side of the Portsmouth Seawalt~ to-wit: All those certain pieces or parcels of land designated as Parcels 1 and 2 on that certain plat entitled "Physical Survey Of Parcel "B" Crawford Harbor Project", dated April 7, t981~ prepared by Robert T. Addison & Associates, Ltd., reference to which plat is hereby made for a more particular description of said property. BE IT FURTHER RESOLVED that the City Manager be~ and he hereby is, authorized to execute a Deed of Release of the hereinabove-described property and such other documents as may be necessary to complete this transaction.
