29 <br /> <br />A RESOLUTION RELEASING A UTILITY EASEMENT IN A PORTION OF QUEEN <br />STREET (CLOSED). <br /> <br /> WHEREAS, by Ordinance adopted by the Council of the City <br />of Portsmouth, Virginia, on August 8, 1967, a portion of Queen <br />Street lying between the Eastern right-of-way line of Route 58 <br />and the Western right-of-way line of Douglas Avenue was closed <br />and vacated as a public street; and <br /> <br /> W~qEREA$, by said Ordinance the City o~ Portsmouth reserved <br />a perpetual right, easement and privilege to maintain, operate <br />and replace all public utility lines now situate within the <br />area so closed and vacated; and <br /> <br /> WRER~AS, the utility lines located in the area of Queen <br />Street which was closed by the aforesaid Ordinance have been <br />relocated by the Public Utility Department; and <br /> <br /> WHEREAS, the City of Portsmouth no longer requires the <br />use of said easement and the same is hereby declared to be <br />excess property of the City; and <br /> <br /> Wt~EREAS, said portion of Queen Street which was closed by <br />the aforesaid Ordinance is located in the Monnt Hermon Conservation <br />and Redevelopment Project and the Portsmouth Redevelopment and <br />Housing Authority has requested that the easement be released in <br />order to make the property available for development; and <br /> <br /> WHEREAS, the Portsmouth Redevelopment a~d Housing Authority <br />owns the underlying fee on the property occupied'by said easement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the easement reserved by the City <br />of Portsmouth to maintain, operate and replace public utility <br />lines within the area of Queen Street lying between %he eastern <br />right-of-way line of Route 58 and the western right-of-way line <br />of Douglas Avenue be, and the same hereby is, released and <br />vacated as a perpetual easement, right and privilege of the <br />City'of Portsmouth. <br /> <br /> BE IT PURTHER RESOLVED that the City Manager be, and he here~y <br />is, authorized to execute a deed~of release relinquishing all <br />rights, privileges and easements which the City reserved in said <br />property. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held April 27, 1982. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
