15 A RESOLUTION OPPOSING THE ADOPTION OF LEGISI~TION WHICH WOULD PROHIBIT LOCAL GOVERNMENTS FROM UTILIZING VALID ZONING ORDINANCES TO REGULATE THE LOCATION OF AN ESTABLISHMENT SELLING ALCOHOLIC BEVERAGES. WHE-~EAS, there is currently pending in the General Assembly of Virginia proposed legislation which would prohibit counties, cities or towns from adopting any zoning ordinance or other land use ordinance to regulate the location of an establishment selling alcoholic beverages; and WHE.-P-EAS, the Supreme Court of Virginia has recently ruled that a municipality may utilize valid zoning ordinances to regulate the location of an establishment s~lling alcoholic beverages as a means to prevent the use of land in a manner the City deems detrimental to the general welfare of its in- habitants and as having a deleterious effect on the community; and WHEREAS, the Council of the City of Portsmouth is of the opinion that the local governing body is the best level of government to dete~n~ine the means and methods by which the public health, safety, convenience and welfare of its citizens can be protected and to facilitate the creation of a con- venient, attractiv~ and harmonious community. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth that it opposes the adoption of any legislation which would restrict the right of the local governing body to determine land use issues and, in particular, any legislation which would prohibit local goverrn~ents from utilizing valid zoning ordinances to regulate the location of an establishment selling alcoholic beverages. BE IT FURTHER RESOLVED that the City Clerk be, and she hereby is, directed to forward copies of this resolution to %he Portsmouth delegation to the General Assembly of Virginia.
