15 <br /> <br />A RESOLUTION OPPOSING THE ADOPTION OF LEGISI~TION WHICH <br />WOULD PROHIBIT LOCAL GOVERNMENTS FROM UTILIZING VALID ZONING <br />ORDINANCES TO REGULATE THE LOCATION OF AN ESTABLISHMENT <br />SELLING ALCOHOLIC BEVERAGES. <br /> <br /> WHE-~EAS, there is currently pending in the General <br />Assembly of Virginia proposed legislation which would <br />prohibit counties, cities or towns from adopting any zoning <br />ordinance or other land use ordinance to regulate the location <br />of an establishment selling alcoholic beverages; and <br /> WHE.-P-EAS, the Supreme Court of Virginia has recently ruled <br />that a municipality may utilize valid zoning ordinances to <br />regulate the location of an establishment s~lling alcoholic <br />beverages as a means to prevent the use of land in a manner <br />the City deems detrimental to the general welfare of its in- <br />habitants and as having a deleterious effect on the <br />community; and <br /> <br /> WHEREAS, the Council of the City of Portsmouth is of the <br /> opinion that the local governing body is the best level of <br /> government to dete~n~ine the means and methods by which the <br /> public health, safety, convenience and welfare of its citizens <br /> can be protected and to facilitate the creation of a con- <br /> venient, attractiv~ and harmonious community. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth that it opposes the adoption of any <br />legislation which would restrict the right of the local <br />governing body to determine land use issues and, in particular, <br />any legislation which would prohibit local goverrn~ents from <br />utilizing valid zoning ordinances to regulate the location of <br />an establishment selling alcoholic beverages. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk be, and she <br /> hereby is, directed to forward copies of this resolution to <br /> %he Portsmouth delegation to the General Assembly of Virginia. <br /> Adopted by the Council of the City of Ports~mo~uth, Virginia, <br /> at a meeting held February 23, 1982. - --- <br /> <br /> Teste: <br /> <br />City Clerk <br /> <br /> <br />
