3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) That the Child Day Care Center may be operated <br />for up to twenty-five (25) children to be cared for zn the <br />facility at any one time and is limited to serve children <br />between two and one-half (2-1/2) to six (6) years of age <br />only. <br /> <br /> (b) That interior operations of the facility will <br />be conducted only between the hours of 6:00 A. M. to 6:00 P. M.. <br />The exterior playyard facilities will only be used between the <br />hours of 8:00 A. M. to 6:00 P. <br /> <br /> (c) <br />five by sixty <br />oz solid wood <br /> <br />That the play area will not be less than sixty- <br />(65' x 60') feet and will be surrounded by a masonry <br />fence at least five (5) feet in haight. <br /> <br /> (d) That the applicant shall comply with all codes, <br />ordinances~ policies and regulations of federal, state and <br />local governments that may be applicable and shall have obtained <br />all necessary licenses and permits required for this use. <br /> <br /> (e) That the use permit is issued to Jesse A. <br />DeBraux, Sr. and is not transferrable to any other person <br />or entity. <br /> <br /> (f) That the applicant will install ~ four [4) <br />foot sidewalk along the north property line beginning at the <br />existing sidewalk on the east property line and going back <br />to the alley on the west property line as shown on the attached <br />site plan. <br /> <br /> (g> That the applicant will provide three (3) <br />parking spaces in back of the building off of the existing <br />alley way as shown on the attached site plan.. <br /> <br /> (h) That the applicant will patch three (3) areas <br />of broken curbing along the north side of the property as <br />shown on the attached site plan. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held February 23, 1982. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
