12 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO JESSE A. DeBP~AUX, SR. <br />TO OPERATE A CHILD DAY CARE CENTER AT 600 BROAD STREET. <br /> <br /> W~EREAS, Jesse A. DeBraux, Sr. made an application <br />pursuant to §40-79(b) of the Code of the City of Portsmouth, <br />Virginia~ 1973, for the granting of a use permit as herein- <br />after-described; and <br /> <br /> W~REAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> W~EREAS, the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED by the Council of the <br />Ci'hy o5 ~ortsmout~l~ Virginia: <br /> <br /> 1. That the use for which the hse permit hereinafter <br />is sought: <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons residing or working in the neighborhood <br />of the proposed use; <br /> <br /> (b) W~ll not be detrimental to the public use <br />or injurious to the property or improvements in the neighbor- <br />hood; and <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. That Jesse A. DeBraux, Sr. is hereby granted a <br />use permit pursuant to §40-79(b) of the Code of the City of <br />Portsmouth to operate a Child Day Care Center at the property <br />described as follows: <br /> <br />UP-81-'24 <br /> <br /> Beginning at the southwest corner of Broad <br />Street and Woodrow Street; thence south along <br />Broad Street 120'; thence west 140' to an alley; <br />thence north along said alley 120' to the south <br />right-of-way of Woodrow Street; thence ess% along <br />said right-of-way 140' to Broad Street, the point <br />of origin. <br /> <br /> <br />
