92 <br /> <br />A RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA <br />TO'AMEND THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA° <br /> <br /> WHEREAS, Section'15.1-835 of the Code of Virginia, 1950, <br />as amended, provides for the amendment of the City Charter <br />upon the holding of a public hearing to determine if the <br />citizens of the City desire that the amendment to the City <br />Charter be granted, and by forwarding thereafter a request <br />to one (1) or more of the members of the General Assembly <br />representing the City to introduce the proposed change as <br />a bill in the succeeding session of the General Assembly; <br />and <br /> <br /> WHEREAS, the City Council is of the opinion that certain <br />amendments to the Charter of the City of Portsmouth is necessary <br />and desirable at thfs time and has, on this date, held such <br />public hearing required by law 'to consider such amendments. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia~ that the City Attorney is <br />hereby directed to prepare and transmit to the members of <br />the General Assembly representing the City, together with <br />certified copies of this resolution, a draft of a bill <br />amending the Charter of the City of Portsmouth, 1970, as <br />follows: <br /> <br /> 1. By amending Article II, S2.02:1 to read a~ <br />follows: <br /> <br />Section 2.O2:1~ Special Service District. <br /> <br /> A special service district of the downtown business <br />district of the City of Portsmouth shall be created by the <br />governing body of the City of Portsmouth, upon petition of <br />fifty-one (5t) percent of the taxpaying property owners of the <br />proposed district. Upon the filing of such petition, the <br />governing body shall fix a date for a public hearing on <br />the question of the proposed service district, which hearing <br />shall embrace a consideraticn of-whether the property within <br />the proposed district will be benefited by the establisb_m~.nt <br />thereof. Notice of such hearing shalt be given by publication <br />once a week for three consecutive weeks in a newspaper of <br />general circulation in the City of Portsmouth, and the <br />hearing shall not be held sooner than ten days after <br />completion of such publication. <br /> <br /> <br />
