3. The use permit is approved subject to the following conditions: (a) That no more than forty (40) children Will be cared for in this facility at any one time and will be limited to children between the ages of two and one-half (2-1/2) to six (6) years. (b) The interior operations of this facility will be conducted only between the hours of 6:00 A. Mo tQ 6:00 P. M.. The exterior playyard facilities will only be used between the hours of 8:00 A. M. to 6:00 P. M. and will be limited to twenty (20) children in the playyard at any one time. (c) The play area shall be between the new and old church buildings, which will be not less than three thousand, five hundred twelve (3,512) square feet as shown on the attached site plan, and will be enclosed on both the north and south ends by a masonry wall or solid wood fence at least five (5) feet in height and have a three (3) foot wide exit gate located on both the north and south ends. (d) The applicant shall comply with all codes, ordinances, policies and regulations of the federal, state and local governments that may be applicable, and shall have obtained all necessary state and local licenses and permits required for this use. (e) The use of the facility as a daycare center, as well as the issuance of an occupancy permit for such, shall not be permitted until the applicant has made all corrections to the old existing church building's electrical system as required by the Building Official's Office. (f) The use of the facility as a daycare center, as well as the issuance of an occupancy permit for such, shall not be permitted until the applicant has complied with all re- quirements of the Code for the construction of the parking lot, or, entered into a contractual agreement with the City Manager to assure the construction of the parking lot in accordance with the requirements of the Code. (g) Upon the commencement of any construction of the proposed addition between the new and old church buildings in the area in which the required playground is located, this u~ pe,-~.mt ~h~ expire~ (h) The use permit is issued to the New Bethel Baptist Church and is not transferable to any other person or entity.
