85 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO SOUTHL~uND CORPORATION <br />TO OPERATE GASOLINE PUMPS (AUTOMOTIVE SERVICE STATION) AT THE <br />EXISTING 1400 EFFINGHAM STREET, 7-ELEVEN FOOD STORE. <br /> <br /> WHEREAS, Southland Corporation, by David N. Walker, <br />Construction Coordinator Representative, made an application <br />pursuant to ~40-70(b) of the Code of the City of Portsmouth, <br />1973, for the granting of a use permit as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter- <br />described is sought: <br /> <br /> (a) Will not adversely affect the health and safety <br />of persons residing or working in the neighborhood of the pro- <br />posed use; <br /> <br /> (b) Will not be detrimental to the public use or <br />injurious to the'property or improvements in the neighborhood; <br />and <br /> <br /> (c) Will be in accord with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Southland Corporation is hereby granted a use permit <br />pnrsuant to ~40-70(b) of the Code of the City of Portsmouth, <br />Virginia to install and operate gasoline pumps for the retail <br />sale of gasoline on the property described as follows: <br /> <br /> Beginning at the northwest corner of <br />~ffingham Street and Duke Streets; thence <br />west along the north right-of-way of Duke <br />Street 105'; thence north 137.32'; thence <br />southeast 5.73'; thence north 101.96 to the <br />south right-of-way of Scott Street; thence <br />east along said right-of-way 100' to the <br />west right-of-way of Effingham Street; thence <br />south along said right-of-way to the north <br />right-of-way of Duke Street, the point of <br />origin.
