79 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY AN <br />EASEMENT ON CITY OWNED PROPERTY TO THE CITY OF SHFFOLK, <br />VIRGINIA (ALABAMA AVENUE AT HOLLYWOOD AVENUE). <br /> <br /> WHEREAS, the City of Portsmouth owns certain real <br />property located in the City of Suffolk acquired from the <br />Berkley and Suffolk Water Company, said property being <br />tocatedat the intersection of Alabama Avenue and Hollywood <br />Avenue; and <br /> <br /> ~REAS, the City of Suffolk desires to acquire an <br />easement on the hereinafter-described portion of said <br />prope~y for the purpose of street improvements to Alabama <br />Avenue; and <br /> <br /> WHEREAS, the City of Suffolk h~s agreed to make such <br />street repairs in a manner so as not to interfere with or <br />damage the City of Portsmouth water transmission line and <br />has also agreed that-the 'City of Portsmouth shall not be <br />responsible for any costs.~related to the street improvement <br />or the maintenance of the water transmission line; and <br /> <br /> WHEREAS, Section 2.O9(c) of the Charter of the City of <br />Portsmouth provides that interest in real property may be <br />conveyed to the Co~onwealth of Virginia or a political <br />subdivision thereof without advertisement or receipt of <br />bids; and <br /> <br /> WHEREAS, the City of Suffolk is a municipal corporation <br />of the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of P~rtsmout~, Virginia, that the City Manager be, and <br />he hereby is, authorized to convey an easement on the <br />hereinafter-described real property located at the inter- <br />section of Alabama Avenue and Hollywood Avenue to the City <br />of Suffolk, said property being more particularly described <br />as follows, to-wit: <br /> <br /> <br />
