6~ <br /> <br />A RESOLUTION GRANTING A USE PE~4IT TO CHILD CARE EQUITIES, <br />INC. TO CONSTRUCT AND OPERATE A CHILD DAYCARE CENTER AT <br />5700 TRUCKER STREET. <br /> <br /> WHERF~S, Larry Turner, President of Child Care Equities, <br />Inc., contract owner for the Trucker Group, has' made appli- <br />cation pursuant to ~40-79 (b) of the Code of the City of <br />Portsmouth, Virginia, 1973, for the granting of a use permit <br />as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Connnission has recommended the <br /> <br />g . <br /> rantlng of said use permit; and <br /> <br /> WH~REAS,I a similar application was approved for La Petite <br />Academy, Inc. on substantially the s~e property by a resolution <br />granted by the Council on January !1, 1983, -~hich did not <br />materialize. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use pez~it is sought: <br /> <br /> (a) Will not affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to the public use or <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Child's World, Inc. is hereby granted a use <br />permit pursuant to ~40-79 (b) of the City Code to operate a <br />child daycare center at 5700 Trucker Street and more particularly <br />described as a portion of Parcel 1 of Tax Plate 815 containing <br />approximately .74 acres (UP-8~-~3. -~ <br /> <br /> 3.
