59 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1973, AS k~E~DED, SAID PROJECT BEING KNOWN <br />AS "ELIZABETH LANDING" AND DESIGNATED AS GHP-83-5. <br /> <br /> W ER A , Micha 1 owe <br /> H E S e R , developer, on behalf of Do~ B. <br />Jackson, o%~ner, has made application pursuant to ~40-55 of <br />the Code of the City of Portsmouth, Virginia, 1973, as amended, <br />for the grantin~ and approval of a group housing project for <br />the construction of an eight (8) unit townhouse/condominium <br />development kno~ as "Elizabeth Landing"; and <br /> <br /> WHEREAS, th? apD!ication has been determined by the <br />Planning CommisSion %o have met the requirements of ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> WHEREAS, the Planning Co~mission has reviewed such appli- <br />cation and site plans submitted therewith and has recommended <br />approval of said application; and ~ <br /> <br /> WHERF~S, t~e developer has been informed that the approval <br />of the group homsing project pursuant to sazd ~40-5~ grants <br />only an exemption from certain requirements for resmdences as <br />stated in said section and does not constitute a waiver of <br />any other requir~ent embodied in the Subdivision Ordinance, <br />the Zoning Ordm~an~e, the Code of the City of Portsmouth, or <br />any other applicable local, state or federal laws or regulations; <br />and <br /> <br /> WHEREAS, the developer is aware that the building permits <br />or an other re]uired permit will be issued only upon compliance <br />with the ordinances, laws, or regulatmons appl!cabme thereto; <br />and <br /> <br /> WHEREAS, the developers have proffered certain terms and <br />conditions for the condominium proposal, and this City Council <br />has considered such terms and conditions together wit~ the re- <br />commendations o~ the City Planning Commission. <br /> <br /> NOW, TPiE~REFORE, BE IT RESOLVED by the ~ouncil of the <br />City of Portsmouth, Virginia that the certamn group housing <br />project kno%m.a? [Elizabeth Landing" and designated as GHP783-5 <br />and more specmficmally shown on the plans and outline specmfications <br />file~ with the appropriate officials of the City of Portsmouth, <br />Virginia on May 16, 1983 and made a part hereof, i~ hereby granted <br />approval subject to the term~ and conditions contained on said <br />plans and outlihe soecificatlons. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held July 26, 1983. <br /> <br />~este. <br /> <br />City Clerk <br /> <br /> <br />
