58 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO NOTTINGHAm4 HO~,~S, LTD. <br />TO CONSTRUCT A S~AGE PUMPING STATION OFF OF PROPOSED REESE <br />DRIVE SOUTH OF THE NOTTINGHAM AT STERLING POINT SUBDIVISION, <br />PHASE III. <br /> <br /> WHEREAS, S. G. Folkes, agent for Nottingham HomEs, Ltd., <br />has made application pursuant to S40-78(b) of the Code of the <br />City of Portsmouth, Virginia, 1973, for the granting of a use <br />permit as hereinafter-described; and <br /> <br /> WHEREAS, the.applicant and the Planning Director have done <br />aL1 thing required to be done in connection with said application; <br />and <br /> <br /> WHEREAS, the Planning Commission has recommended the grant- <br />ing of said use permit. <br /> <br /> NOW, THEREFORE, BE IT _R_ESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the use for which the use oermit is sought: <br /> <br /> (a) Will <br />of persons residing <br />u~e; <br /> <br />not adversely affect the health and safety <br />or working iR the neighborhood of the proposed <br /> <br />injurious <br />and <br /> <br />(.b) Will not be detrimental to the public use or <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. Nottingham Homes, Ltd. is hereby granted a use permit <br />pursuant to ~40-78(b) of the City Code to construct a sewage <br />pumping station off of the proposed Reese Drive South of the <br />Nottingham At Sterling Point Subdivision, Phase III. <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br /> (a) Occupancy permits for Nottingham, Phase III, <br />shall not be issued until screening and landscaping is provided <br />to buffer the surrounding residences. Such landscaping plan <br />shall be submitted to and approved by the Planning Department <br />prior to the issuance of such occupancy permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held July 26, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
