A RESOLUTION PROVIDING FOR AM_ENDMENT TO THE ARTICLES OF INCORPORATION O~ THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA. BE IT RESOLVED by the Council of the City of Portsmouth: 1. That the City of Portsmouth (the "City") has found and determined and does hereby declare that: (a) The cities of Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and Virginia Beach and the counties of Isle of Wight and Southampton have heretofore created the Southeastern Public Service Authority of Virginia (the "Authority") pursuant to the provisions of the Virginia Water amd Sewer Authorities Act, being Chapter 28, Title 15.1 of the Code of Virginia, 1950, as amended, in the manner and for the purposes set forth therein. (b) By certificate of amendment issued and admitted to record in hhe office of the State Corporation -CoTmnission of the Cormuon%¢ealth of Virginia on January 23, 1976, the Articles of Incorporation of the Authority were amended so as to change the name of the Authority and so as to ~mend its purposes in certain respects. (c) Tine City, together with the other members of the Authorit~, now desires to further amend the Articles of Incorporation of the Authority by approval of the Articles of Amendment of the Southeastern Public Service Authority of Virginia set forth below, in accordance with the provisions of ~15.1-1250 (o) of the Code of Virginia, 1950,.~as amended: ARTICLES OF ~4ENDMENT OF THE SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA The Articles of Incorporation of the Southeastern Public Service Authority of Virginia, as amended, shall be further amended by striking out section (d) and substituting the following: (d) The purposes for which the Authority is to be formed are to acquire, finance, construct, operate and maintain a water system and a garbage and trash collection and disposal system, all pursuant to the provisions of the Virginia Water and Sewer Authorities Act.
