28 A RESOLUTION AUTHORIZING THE CITY MANAGER TO GHANT AN ~ASEMENT TO THE CHESAPEAKE AND POTOMAC TELEPHONE COMPANY OF VIRGINIA (CEDAR LANE FIRE STATION PHOPERTY). WHEREAS, the Chesapeake and Potomac Telephone Company of Virginia has requested the City of Portsmouth to grant an ease- ment along the northern and eastern boundary of City-owned property on Cedar Lane for the purpose of installing ~nderground telephone utility cables; and WHEREAS, the installation of said equipment is being made in connection with improvements to Cedar Lane and for upgrading service of the customers of the Chesapeake and Potomac Telephone Company of Virginia; and WHEREAS, the installation of said equipment will not inter- fere with bhe operation of the Cedar Lane Fire Station; and WHEREAS~ the Chesapeake and Potomac Telephone Company of Virginia shall agree to relocate or remove its facilitiesr at no cost to the City, if future development of the Cedar Lane Fire Station shall require the same to be removed or relocated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to grant an easement to the Chesapeake and Potomac Te!eohone Company of Virginia over, under and across the here- inaf%er-described property, to--wit: Beginning at a point on the eastern boundary of Cedar Lane, said point being 403.59 feet south from the intersection of Cedar Lane and Clintwood Drive; thence south 85° 48' 00" eas= 9.99 feet to a point; thence south 72° 49' 00" east 194.20 feet to a point; thence south 4° 12' 00" west 78.57 fee~ to a point; thence south 85° 48' OO" east 5.50 feet to a point; thence south 4° 12' 00" west 165 feet to a point; thence south 72° 49' O0" east 7.69 feet to a point; thence north 4° 12' O0" east 172.07 feet to a point; thence north 85° 48' 00" west 9.00 feet to a point; thence north 4° 12' 00" east 80.00 feet to a point; thence north 72° 49' OO" west 208.65 feet to a point on the eastern boundary of Cedar Lane; thence south 4° 12' 00" west along the eastern boundary of Cedar Lane 10 feet to the Point of Be- beginning. Said property being more particularly described on the plat entitled "Plat Showing Proposed Utility Easement To Be Conveyed To C & P Telephone Company From City of Portsmouth", dated January 7, 1982 and prepared by the Engineering & Technical Services Department of the City of Portsmouth, Virginia.
