28 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO GHANT AN ~ASEMENT <br />TO THE CHESAPEAKE AND POTOMAC TELEPHONE COMPANY OF VIRGINIA <br />(CEDAR LANE FIRE STATION PHOPERTY). <br /> <br /> WHEREAS, the Chesapeake and Potomac Telephone Company of <br />Virginia has requested the City of Portsmouth to grant an ease- <br />ment along the northern and eastern boundary of City-owned <br />property on Cedar Lane for the purpose of installing ~nderground <br />telephone utility cables; and <br /> <br /> WHEREAS, the installation of said equipment is being made <br />in connection with improvements to Cedar Lane and for upgrading <br />service of the customers of the Chesapeake and Potomac Telephone <br />Company of Virginia; and <br /> <br /> WHEREAS, the installation of said equipment will not inter- <br />fere with bhe operation of the Cedar Lane Fire Station; and <br /> <br /> WHEREAS~ the Chesapeake and Potomac Telephone Company of <br />Virginia shall agree to relocate or remove its facilitiesr at <br />no cost to the City, if future development of the Cedar Lane <br />Fire Station shall require the same to be removed or relocated. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he hereby <br />is, authorized to grant an easement to the Chesapeake and Potomac <br />Te!eohone Company of Virginia over, under and across the here- <br />inaf%er-described property, to--wit: <br /> <br /> Beginning at a point on the eastern boundary <br />of Cedar Lane, said point being 403.59 feet south <br />from the intersection of Cedar Lane and Clintwood <br />Drive; thence south 85° 48' 00" eas= 9.99 feet to <br />a point; thence south 72° 49' 00" east 194.20 feet <br /> <br />to a point; thence south 4° 12' 00" west 78.57 fee~ <br />to a point; thence south 85° 48' OO" east 5.50 feet <br />to a point; thence south 4° 12' 00" west 165 feet <br />to a point; thence south 72° 49' O0" east 7.69 feet <br />to a point; thence north 4° 12' O0" east 172.07 feet <br />to a point; thence north 85° 48' 00" west 9.00 feet <br /> <br />to a point; thence north 4° 12' 00" east 80.00 feet <br />to a point; thence north 72° 49' OO" west 208.65 feet <br />to a point on the eastern boundary of Cedar Lane; <br />thence south 4° 12' 00" west along the eastern <br />boundary of Cedar Lane 10 feet to the Point of Be- <br />beginning. <br /> <br /> Said property being more particularly described <br />on the plat entitled "Plat Showing Proposed Utility <br />Easement To Be Conveyed To C & P Telephone Company <br />From City of Portsmouth", dated January 7, 1982 and <br />prepared by the Engineering & Technical Services <br />Department of the City of Portsmouth, Virginia. <br /> <br /> <br />
