104 <br /> <br />A RESOLUTION AMENDING THE USE PERMIT GRANTED TO MR. AND ~S. <br />THO~4AS-.B; VEI~ASCO..TO OPERATE k PRIVATE RESIDENCE.AND HOME. FOR <br />THE ELDERLY NEAR THE INTERSECTION OF UTAH STREET AND KINGMAN <br />AVENUE. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia, <br />granted a use permit to Mr. and Mrs. Thomas B.~Velasco to <br />operate a private residence and home for the ~derly near the <br />intersection of Utah Street and Kingman Avenue~ on January 8, <br />1980, which permitted no more than nine (9) elderly female <br />guests in the convalescent and nursing home; and <br /> WHEREAS, Mr. and ~4rs. Velasco has made application pursuant <br />to §40-75 (b) of the Code of the City of Portsmouth, Virginia, <br />!973~ to amend said use permit to add four (4) additional elderly <br />persons~ and <br /> WHEREAS, the applicant and the Planning Director have done <br /> all things required to be done in connection with said appli- <br /> cation; and <br /> WHEREAS, the Planning Commission has recommended the grant- <br /> ing of said use permit. <br /> NOW, T}{EREFORE, BE IT RESOLVED by the Council of the City <br /> <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use <br />described is sought: <br /> <br />permit hereinafter- <br /> <br /> (a~ will not adversely affect the health and safety <br />of persons residing and working in the neighborhood of the pro- <br />posed use; <br /> <br /> (b) Will not be detrimental t¢~ the public use or <br />injurious to property and improvements in the neighborhood; and <br /> (c) ~will be in accord with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. That Mr. and Mrs. Thomas B. Velasco is hereby granted <br /> a use permit pursuant to Section 40-75 (b) of the Code of the <br /> City of Portsmouth, Virginia, 1973, to operate a private resi- <br /> dence and home for the elderly on property hereinafter-described: <br /> <br /> <br />
