: ~ 90 <br /> <br />A RESOLUTION GRANTING A USE PEP~MIT TO EARL J. COOK, SR. TO <br />OPERATE AN AUTO JUNKYARD AT 705-707 YORKTO!~N AVENUE. <br /> <br /> WHEREAS, Earl J. Cook, Sr., has made ~pplication pursuant <br />to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, <br />1973, for the granting of a use permit as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done <br />all things required to be done in connection with said appli- <br />cation; and <br /> <br /> WHEREAS, the Planning Co~ission has made a recommendation <br />regarding the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the C~ty <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter- <br />described is sought: <br /> <br />of persons <br />posed use; <br /> <br />(a) Will not adversely <br />residing or working in <br /> <br />affect ~he health and safety <br />the neighborhood of the pro- <br /> <br /> (~) Will not be detrimental to the public use or <br />injurious to the property or improvements qf the neighborhood; <br />and <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Earl J. Cook, Sr. is hereby granted a use permit <br />pursuant to ~40-69 (h) of the Code of the City of Portsmouth, <br />Virginia to operate an auto junkyard at 7G5-707 Yorktown Avenue, <br />being more particularly described at Tax ~p 113, Parcels 34, <br />35, 36, 62 and 62-1, this area containing approximately 32,975 <br />square feet or 0.755 acres ~UP-83-6). <br /> <br /> 3. This use permit is approved subject to the following <br />conditions: <br /> <br />(a) That automobiles may not be sheared at the location. <br /> <br /> (b) That automobile skeletons shall not permanently <br />stored on the property. <br /> <br /> (c) That all junk automobiles a~aiting dismanteling <br />and automobile skeletons awaiting removal shall be stored within <br />a fenced compound and that no temporary parking, stopping or <br /> <br /> <br />
