: ~ 90 A RESOLUTION GRANTING A USE PEP~MIT TO EARL J. COOK, SR. TO OPERATE AN AUTO JUNKYARD AT 705-707 YORKTO!~N AVENUE. WHEREAS, Earl J. Cook, Sr., has made ~pplication pursuant to ~40-69 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said appli- cation; and WHEREAS, the Planning Co~ission has made a recommendation regarding the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the C~ty of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter- described is sought: of persons posed use; (a) Will not adversely residing or working in affect ~he health and safety the neighborhood of the pro- (~) Will not be detrimental to the public use or injurious to the property or improvements qf the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Earl J. Cook, Sr. is hereby granted a use permit pursuant to ~40-69 (h) of the Code of the City of Portsmouth, Virginia to operate an auto junkyard at 7G5-707 Yorktown Avenue, being more particularly described at Tax ~p 113, Parcels 34, 35, 36, 62 and 62-1, this area containing approximately 32,975 square feet or 0.755 acres ~UP-83-6). 3. This use permit is approved subject to the following conditions: (a) That automobiles may not be sheared at the location. (b) That automobile skeletons shall not permanently stored on the property. (c) That all junk automobiles a~aiting dismanteling and automobile skeletons awaiting removal shall be stored within a fenced compound and that no temporary parking, stopping or
