89 <br /> <br />A RESOLUTION G-RA-~T~G A USE PER~.~IT TO REVEREND CLARENCE <br />SINGLETARY FOR A CHURC A_~D HOUSE OF WQRSHIP AT 459 EFFINGF~AM <br />STREET · <br /> <br /> WHEREAS, Max ~ar~an, owner, by Pastor Clarence H. <br />Singletary, lessee, has ~ade application pursuant to ~0-72 <br />Cb) of the Code of the C~ty of Portsmouth,· Virginia,~ 1973,, <br />for the granting of a use ~e~mi% as hereinafter-described; <br />and <br /> WHEREAS, th~ applicant and the Planning Director have <br />done all things requized to be done in connection with'said <br />~pplication; and ~ <br /> WHEREAS, the~Planning Co~ssion has recommended the <br />granting of said use De~mit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> 1. That the use for wD~Ich the use per, it hereinafter- <br /> described is sought: <br /> <br /> ~a) Will not as a temporary use for a period not <br /> to exceed e~ghteen ~18} months adversely affect the health <br /> and safety of persons residing or working in the neighborhood <br /> of the proposed use; <br /> ~b) will not as a temporary use for a period not to <br /> exceed eighteen ~_18) months be detrimental to the public use or <br /> injurious to the property or improvements of the neighborhood; <br /> and <br /> <br /> (C) Will as a temporary use for a period not to exceed <br /> eighteen (18) months be in accordance with the purposes of <br /> the Zoning Chapter of the City Code. <br /> 2. Clarence H. Singletary is hereby granted a use permit <br /> pursuant to S40-72 (b) of the Code'of the City of Portsmouth, <br /> Virginia to operate a church and place of worship at 459 Effingham <br /> Street, being more particularly described as Tax Map 18, Parcel <br /> 95 ~UP-83-4) · <br /> 3. This use permit is approved subject to the following <br /> conditions: <br /> <br /> ~ The applicant will comply with all codes, ordinances <br /> and regulations o~ Commercial C-3 Zoning District requirements <br /> relat±ng to the operation of churches and houses of worship. <br /> <br /> <br />
