33 A RESOLUTION GRANTING A USE PERMIT TO MARYVIEW HOSPITAL CORPORATION FOR PROPERTY WEST OF THE ABANDONED RAILROAD RIGHT-OF-WAY LYING BETWEEN PRINCETON PLACE ~ND WESTERN BRANCH BOULEVARD (TAX MAP 354, PARCEL 1 AND TAX MAP 355, PARCELS 5 AND 9). WHEREAS, Maryview Hospital Corporation has made appl$cation for an amendment to a use permit granted for the operation of a hospital and related facilities on High Street at Willett Drive by the Council of the City of Portsmouth, Virginia, on April 23, 1974; and WHEREAS, Section 40-48 of t~e Code of the City of Portsmouth, Virginia, 1973, provides that parking space required for any use located in any residential district may, by use permit, incorporate land not contiguous with the principal use when included on a site plan referenced in a City Council resolution granting such conditional use permit; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application, and the Planning Commission has recommended that said amendment to the use permit be granted. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the zoning chapter of the City Code. 2. Maryvlew Hospital Corporation is hereby granted an amendment to the use permit granted for the operation of a hospital and related facilities on High Street at Willett Drive on April 23, 1974 and is permitted to operate a parking lot pursuant to Section 40-48 of the Code of the City of Portsmouth, Virginia, 1973, on the property described as follows:
