137 A RESOLUTION GRANTING A USE PERMIT TO DR. HUGO A. OWENS, SR., FOR A FUNERAL HOME AT 610 GREEN STREET. WHEREAS, Dr. Hugo A. Owens, Sr., owner, has made application pursuant to ~40-121 (a) (i) of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has made a recommendation pertaining to the granting of said use permit. NOW, THEREFORE, BE ~T RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood the proposed use; of (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Dr. Hugo A. Owens, Sr. is hereby granted a use permit pursuant to ~40-121 (a) (i) of the Code of the City of Portsmouth, Virginia to operate a funeral home at 610 Green Street (Tax Map 25, Parcel 32). 3. This use permit is approved subject to the following conditions: provided homes. (a) Off-street automobile parking shall be as specified in ~40-45 for morturaries and funeral (b) The applicant shall provide improvements to the facade of the building and garage and shall submit such proposed improvements to the D-1 Design Committee for their review and approval within ninety (90) days from the date of the issuance of this use permit.
