119 <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO PAMELA F. <br />OPERATE A FAMILY CARE HOME AT 113 BEATON DRIVE. <br /> <br />REID TO <br /> <br /> WHEREAS, Pamela Reid has made application pursuant <br />to ~40-75 (b] of the Code of the City of Portsmouth, <br />Virginia, 1973, for the granting of a use permit to <br />operate a family care home; and <br /> <br /> WHEREAS, the applicant and the Planning Directo~ <br />have done all things required to be done in connection <br />with said application; and <br /> <br /> WHEREAS~ the Planning Commission has recommended <br />the granting of a use permit for the operation of a <br />family care home. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia: <br /> <br />1. That the use for which the use permit is <br />sought: <br /> <br /> (a) Will not adversely affect the health and <br />safety of persons ~esiding or working in the <br />neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use <br />or injurious to the property or improvements in the <br />neighborhood; and <br /> <br /> (c) Will be in accordance with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> 2. Pamela Reid is hereby granted a'use permit <br />pursuant to ~40-75 (b) of the City Code to operate a <br />family ca~e home, as that term is defined in ~40-31 of <br />the City Code, at the property described as Tax Plate <br />422, Parcel 15, and designated as 113 Beaton Drive <br />(UP-85-26). <br /> <br /> 3. The use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Ail inte~io~ operations shall be <br />conducted between the hours of 6:00 a. m. and 6:00 p. <br /> <br /> (b) Ail outdoor play activities shall be <br />conducted within a fenced play a~ea and limited to the <br />hours between 8:00 a. m. and 6:00 p. m.. <br /> <br /> <br />
