16 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO S40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING 12 CONDOMINIUM <br />UNITS IN 3 BUILDINGS OF 4 UNITS EACH CALLED NOTTOWAY CONDOMINIUMS <br />TO BE LOCATED AT 3715-3721 KING STREET. <br /> <br /> WHEREAS, Richard P. Molenaar, James Wayland, and Michael <br />Rowe, has made application pursuant to ~40-55 of the Code of <br />the City of Portsmouth, Virginia, 1973, as amended, for the <br />granting and approval of a group housing project consisting <br />of 12 condominium units in 3 buildings of 4 units each to be <br />located at 3715-3721 King Street~ and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 of <br />the Code of the City of Portsmouth, Virginia, 1973, as amended; <br />and <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plan submitted therewith and has recommended <br />a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section, and does not constitute a waiver of any other <br />requirement embodied in the subdivision ordinance, zoning <br />ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; <br />and <br /> <br /> ?WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the certain group housing project <br />consisting of 12 condom±nium units in 3 buildings of 4 units <br />each at 3715-3721 King Street and designated as GHP-85-1, and <br />more specifically described in corresponde~nce from Metro Develop- <br />ment Corporation, Richard P. Molenaar, Vice President, dated <br />December 5, 1984 and shown on plans designated "Nottoway Con- <br />dominiums'' and filed with the appropriate officials of the City <br />of Portsmouth, Virginia, such being made a part hereof, is <br />hereby granted approval subject to the following terms and con- <br />ditions: <br /> <br /> -1. A detailed landscape plan, including a walkway system <br />from parking to entrances and screening the parking along the <br />rear and side property lines, must be submitted to the Planning <br />Office for revlew and approval prior to issuance of building <br />permits. <br /> <br /> <br />
