WHEREAS, by plat entitled "Plat of Property Belonging to <br />City of Portsmouth for Waterfront Development", dated January <br />20, 1977, recorded in the Clerk's Office of the Circuit Court <br />of the City of Portsmouth, Virginia, in Map Book 10, page 6, <br />certain hereinafter described easements and rights-of-way <br />were dedicated for the purpose of constructing public <br />utilities and improvements; and <br /> <br /> WHEREAS, the proposed plan for development by Master <br />Development Corporation requires that the <br />hereinafter-described easements and rights-of-way be released <br />in order to facilitate construction and development; and <br /> <br /> WHEREAS, the said easements and rights-of-way are no <br />longer required by the City for public utility purposes and <br />are hereby declared to be surplus property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth that the City Manager be, and he hereby <br />is, authorized to convey parcels 6lA, 61D, 61E, 61F and 61G <br />as shown on that certain plat entitled "Plat Showing Survey <br />of Development Parcel 6lA.thru 61G, Crawford Renewal Project, <br />VAR-53," prepared by A.M.L. Surveying, dated April 17, 1985, <br />revised May 16, 1985, and June 14, 1985, attached hereto, <br />subject to the terms and conditions of a certain development <br />agreement between the City, Portsmouth Redevelopment & <br />Housing Authority and Master Development Corporation dated <br />kugust i3, 1985, and subject to conditions and restrictions <br />of record pertaining thereto. <br /> <br /> BE ~IT~FURTHER RESOLVED that the Ci~y Manager is hereby <br />instructed to retain easements on a portion of the s~bject <br />property for pedestrian access and access for emergency and <br />service vehicles and to~convey a portion of the subject <br />property subject to,certain ~onditions pertaining to <br />maintenance thereof and liabilf~y for damages; said easements <br />and conditions to apply to parcels 61D, 61E, 61F and 61G. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager, and <br />hereby is, authorized to release certain <br />hereinafter-described easements and ~ights-of-wav <br />in connection with the conveyance of said property: <br /> <br />he <br /> <br />Parcel I <br /> <br /> Ail that certain 15' drainage easement as <br />shown on that certain plat entitled "Plat of <br />Property Belonging to City of Portsmouth for <br />Waterfront Development," recorded in the <br />Clerk's Office of the Circuit Court of the <br />City of Portsmouth in Map Book 10, page 6; <br />said easement being described as lying along <br />the eastern boundary of the property depicted <br /> <br /> <br />
