4 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY <br />CITY-OWNED PROPERTY (DEVELOPMENT PARCELS 6lA, 61D, 61E, 61F <br />AND 61G, CRAWFORD RENEWAL PROJECT, VAR-53) TO PORTSMOUTH <br />REDEVELOPMENT & HOUSING AUTHORITY SUBJECT TO THE TE~4S AND <br />CONDITIONS OF THE DEVELOPMENT AGREEMENT; RETAINING TO THE <br />CITY AN EASEMENT FOR PEDESTRIAN ACCESS AND ACCESS FOR <br />EMERGENCY AND SERVICE VEHICLES, AND SUBJECT TO CONDITIONS <br />PERTAINING TO MAINTENANCE AND LIABILITY FOR DAMAGES; <br />AUTHORIZING THE CITY MANAGER TO RELEASE CERTAIN EASEMENTS <br />RIGHTS-OF-WAY IN CONNECTION WITH SAID CONVEYANCE. <br /> <br />AND <br /> <br /> WHEREAS, the City owns certain hereinafter-described <br />real property which property is no longer needed by the City <br />for public purposes and is hereby declared to be surplus <br />property; and <br /> <br /> WHEREAS, Portsmouth Redevelopment & Housing Authority by <br />due notice and advertisement has requested proposals for the <br />acquisition, use and development of said property and has <br />recommended the approval of the plan of Master Development <br />Corporation; and <br /> <br /> WHEREAS, the City, Portsmouth Redevelopment & Housing <br />Authority and Master Development Corporation have entered <br />into a development agreement dated August 13, 1985 for <br />acquisition, use and~developmen~ in accordance with the said <br />approved plans; and <br /> <br /> WHEREAS, the said d~velopmeat agreement provides for the <br /> conveyance of said property to Portsmouth Redevelopment & <br /> Housing Authority subject to certain easements and conditions <br /> per~taining to access, maintenance and liability for damages <br /> on a portion of the property; and <br /> <br /> WHEREAS, the said acquisition, use and development plans <br /> have been included in the above-referenced development <br /> agreement; and <br /> <br /> WHEREAS, Section 2.09 of the Charter of the City of <br /> Portsmouth provides that property may be conveyed to the <br /> Commonwealth of Virginia, or a political subdivision thereof, <br /> without advertisement or receipt of bids; and <br /> <br /> WHEREAS, Portsmouth Redevelopment & Housing Authority is <br /> a political subdivision of the Commonwealth of Virginia; and <br /> <br /> <br />
