88 <br /> <br />A RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br />CONSISTING OF 28 UNITS AT THE NORTHWEST CORNER OF DEEP <br />CREEK BOULEVARD AND BENTON AVENUE AND DESIGNATED AS <br />GHP-85-16. <br /> <br /> WHEREAS, Reubin Manning, has made application <br />pursuant to Section 40-55 of the Code of the City of <br />Portsmouth, Virginia, 1973, for the granting and <br />approval of a group housing project consisting of <br />thirty-two (32) units at the northwest corner of Deep <br />Creek Boulevard and Benton Avenue~ and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of <br />Section 40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed said <br />application and site plan submitted therewith and has <br />recommended a conditional approval of said application <br />limiting the development to a portion of the requested <br />property and permitting only twenty-eight (28) units to <br />be constructed thereon; and <br /> <br /> WHEREAS, the developer has been informed that <br />approval of a group housing project pursuant to Section <br />40-55 grants only an exemption from certain requirements <br />for residences as stated in said section, and does not <br />constitute a waiver of any other requirement embodied in <br />the subdivision ordinance, zoning ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building <br />permits or any other required permit will be issued only <br />upon compliance with the ordinances, laws, or <br />regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, virginia, that the certain group <br />housing project designated as GHP-85-16 proposing a <br />development of thirty-two (32) apartments in the <br />northwest corner of Deep Creek Boulevard and Benton <br />Avenue be revised to permit the construction of <br />twenty-eight (28) units on that portion of the parcel <br />currently zoned R-60 as shown on that plat entitled <br />"Lots 15, 16, 17 and 18 Highland Park or Biltmore", <br />prepared by Hoggard-Eure Associates and described in <br />correspondence dated August 13, 1985, such being made a <br />part hereof, is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> <br />
