A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT <br />CONSISTING OF 184 APARTMENTS ON 12.8 ACRES LOCATED WEST <br />OF TOWNE POINT ROAD AND NORTH OF THE CORPORATE CITY <br />LIMITS. <br /> <br /> WHEREAS, January 16th Associates, by Benjamin J. <br />Levy, General Partner, has made application pursuant to <br />Section 40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, for the granting and approval of a group <br />housing project consisting of one hundred eighty-four <br />(184) apartments on 12.8 acres located west of Towne <br />Point Road and north of the corporate City limits; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of <br />Section 40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission <br />application and site plans submitted <br />recommended a conditional approval of <br />and <br /> <br />has reviewed said <br />therewith and has <br />said application; <br /> <br /> WHEREAS, the developer has been informed that <br />approval of a group housing project pursuant to Section <br />40-55 grants only an exemption from certain requirements <br />for residences as stated in said section, and does not <br />constitute a waiver of any other requirement embodied in <br />the subdivision ordinance, zoning ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware <br />permits or any other required permit <br />upon compliance with the ordinances, <br />applicable thereto. <br /> <br />that building <br />will be issued only <br />laws or regulations <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia, that the certain group <br />housing project consisting of one hundred eighty-four <br />(184) apartments on 12.8 acres located west of Towne <br />Point Road and north of the corporate City limits and <br />designated as GHP-85-26 and more specifically described <br />in correspondence from Kramer/Levy Associates, dated <br />June 11, 1985 as shown on plans designated "Towne Point <br />Apartments" filed with the appropriate officials of the <br />City of Portsmouth, Virginia, such being made a part <br />hereof, is hereby granted approval subject to the <br />following terms and conditions: <br /> <br /> <br />
