80 A RESOLUTION GRANTING A USE PERMIT TO JANUARY 16TH ASSOCIATES TO OPERATE GASOLINE PUMPS IN CONJUNCTION WITH A CONVENIENCE STORE ON THE WEST SIDE OF TOWN5 POINT ROAD SOUTH OF BICKFORD PARKWAY. WHEREAS, January 16th Associates have made application pursuant to Section 40-70 (b) of the Code of the City of Portsmouth, Virginia, 1973, for thegranting of a use permit as hereinafter described; and WHEREAS, the applicant and the done all things required to be done said application; and Planning Director have in connection with WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or in3urious to the property or improvements of the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. January 16th Associates is hereby granted a use permit pursuant to Section 40-70 (b) of the Code of the City of Portsmouth, Virginia, 1973, to operate gasoline pumps in conjunction with a convenience store on property on the West side of Towne Point Road lying south of Bickford Parkway, such property being more particularly described as follows: UP-85-14 Beginning at the southeast intersection of Towne Point Road and Bickford Parkway (relocated); thence west along the south right-of-way of Bickford Parkway 150', more or less; thence southerly 150', thence east 150' to the west right-of-way of Towne Point Road; thence north 150' along said right-of-way to the point of origin.
