77 A RESOLUTION GRANTING A USE PERMIT TO THE CATHEDRAL OF PRAISE CHURCH TO OPERATE A CHILD CARE CENTER AT 715 SUMMERS PLACE (UP-85-17). WHEREAS, The Cathedral of Praise Church, by John O. and Linda N. McCloud, Trustees, has made application pursuant to Section 40-75 (b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit to operate a child care center at 715 Summers Place; and WHEREAS, the applicant and the done all things required to be done application; and Planning Director have in connection with said WHEREAS, the Planning Commission has recommended the granting of a use permit for the operation of a child care center. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 2. The Cathedral of Praise Church is hereby granted a use permit pursuant to Section 40-75 (b) of the City Code to operate a child care center at 715 Summers Place (Tax Map 509, Parcel 40) which contains 2.23 acres (UP-85-17). 3. This use permit is approved subject to the following conditions: (a) The child care center may be operated with an enrollment of not more than eighty (80) children to be cared for at the facility at any one time. (b) All interior operations of the facility must be conducted between the hours of 6:00 a. m. and 6:00 p.
