75 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, <br />CONSISTING OF 48 UNITS OF HOUSING FOR THE ELDERLY ON <br />1.75 ACRES WEST OF MARTIN AVENUE AND SOUTH OF PORTSMOUTH <br />BOULEVARD AND DESIGNATED AS GHP-85-23. <br /> <br /> WHEREAS, George Eberwine and E. A. Barham, Jr., <br />have made application pursuant to Section 40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, for the <br />granting and approval of a group housing project <br />consisting of forty eight (48) rental apartment units <br />for the elderly in a two-story structure on a 1.75 acre <br />parcel behind the First Friends Church on Portsmouth <br />Boulevard and 150 feet west of Martin Avenue, such site <br />being more particularly described as follows: <br /> <br />GHP-85-23 <br /> <br /> Beginning on the north right-of-way <br />line of Sacony Street 149.65' west from <br />its intersection with the west right-of-way <br />of Martin Avenue; thence north 353.99'; <br />thence west 40'; thence south 35'; thence <br />west 138.54'; thence south 410'; thence <br />east 178.2'; thence north 50' to the north <br />right-of-way of Sacony Street, the point of <br />origin. <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of <br />Section 40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed said <br />application and site plans submitted therewith and has <br />recommended a conditional approval of said application; <br />and <br /> <br /> WHEREAS, the developer has been informed that <br />approval of a group housing project pursuant to Section <br />40-55 grants only an exemption from certain requirements <br />for residences as stated in said section and does not <br />constitute a waiver of any other requirement embodied in <br />the subdivision ordinance, zoning ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable <br />local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that <br />permits or any other required permit will <br />upon compliance with the ordinances, laws <br />applicable thereto. <br /> <br />building <br />be issued only <br />or regulations <br /> <br /> <br />
