8 <br /> <br />A RESOLUTION GRANTING A SPECIAL EXCEPTION TO THE TtDEWATHR <br />BUILDING AT 454 GREEN STREET FOR OFF-STREET PARKING IN THE <br />DOWNTOWN D-1 DISTRICT. <br /> <br /> WHEREAS, Spencer L. Scott, Architect, has made appli- <br />cation for the granting of a special exception to the off- <br />street parking requirements for the Tidewater building at <br />454 Green Street pursuant to ~40-121 (b) (IV) in the Down- <br />town D-1 District; and <br /> <br /> ~EREAS, the applicant and the Planning Director have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> ~EREAS, the Planning Commission has made a recommendation <br />for the granting of a special exception to the off-street parking <br />requirements. <br /> <br /> NOW, THEREPORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br />1. That the special exception to be granted: <br /> <br /> (a) Will not adversely affect the health an~ safety <br />of persons residing or working in the neighborhood; <br /> <br />injurious <br />and <br /> <br />(b) Will not be detrimental to the public use or <br />to the property or improvements in the neighborhood; <br /> <br /> (c) Will be in accord with the purposes and objectives <br />of the Downtown D-1 District and the Zoning Chapter of the City <br />Code. <br /> <br /> 2. Spencer L. Scott is hereby granted a snecial execution <br />to the off-street parking requirements in the Downtown D-1 ~istrict <br />as provided for in ~40-121 (b) (IV) for the Tidewater building at <br />454 Green Street by the granting of a variance of three (3) spaces, <br />such special exception being approved subject to the following <br />conditions: <br /> <br />renovated <br />the three <br /> <br />(a) The Tidewater building at 454 Green Street is <br />to provide twelve (!2~ one bedroom apartments within <br />story structure. <br /> <br /> (b) The development shall provide for twelve (12) <br />off-street parking spaces as shown on the site plan filed with <br />the appropriate officials of the City of Portsmouth, Virginia, <br />such site plan being made a part hereof. <br /> <br /> <br />
