8 A RESOLUTION GRANTING A SPECIAL EXCEPTION TO THE TtDEWATHR BUILDING AT 454 GREEN STREET FOR OFF-STREET PARKING IN THE DOWNTOWN D-1 DISTRICT. WHEREAS, Spencer L. Scott, Architect, has made appli- cation for the granting of a special exception to the off- street parking requirements for the Tidewater building at 454 Green Street pursuant to ~40-121 (b) (IV) in the Down- town D-1 District; and ~EREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and ~EREAS, the Planning Commission has made a recommendation for the granting of a special exception to the off-street parking requirements. NOW, THEREPORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the special exception to be granted: (a) Will not adversely affect the health an~ safety of persons residing or working in the neighborhood; injurious and (b) Will not be detrimental to the public use or to the property or improvements in the neighborhood; (c) Will be in accord with the purposes and objectives of the Downtown D-1 District and the Zoning Chapter of the City Code. 2. Spencer L. Scott is hereby granted a snecial execution to the off-street parking requirements in the Downtown D-1 ~istrict as provided for in ~40-121 (b) (IV) for the Tidewater building at 454 Green Street by the granting of a variance of three (3) spaces, such special exception being approved subject to the following conditions: renovated the three (a) The Tidewater building at 454 Green Street is to provide twelve (!2~ one bedroom apartments within story structure. (b) The development shall provide for twelve (12) off-street parking spaces as shown on the site plan filed with the appropriate officials of the City of Portsmouth, Virginia, such site plan being made a part hereof.
