42 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE <br />CITY OF PORTSMOUTHr VIRGINIA, 1973, SAID PROJECT BEING A <br />FOUR (4) UNIT APARTMENT BUILDING AT-THE NORTHEAST CORNER <br />OF HARTFORD STREET AND DOUGLAS AVENUE AND DESIGNATED AS <br />GHP-85-9. <br /> <br /> WHEREAS, Robert W. McCarty, contract owner, <br />has made application pursuant to Section 40-55 of the <br />Code of the City of Portsmouth, Virginia, 1973, as <br />amended, for the granting and approval of a Group <br />Housing Project consisting of a four (4) unit apartment <br />building at the northeast corner of Hartford Street and <br />Douglas Avenue in Port Norfolk; and <br /> <br /> WHEREAS, the ~pplication filed by Kirk <br />Berkley, Architect, has been determined by the Planning <br />Commission to have met the requirements of Section <br />40-55; and <br /> <br /> WHEREAS, the Planning Commission has reviewed <br />such application and site plans submitted therewith and <br />has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that <br />approval of a Group Housing Project pursuant to Section <br />40-55 grants only an exemption from certain requirements <br />for residences as stated in said section and does not <br />constitute a waiyer of any other requirement embodied in <br />the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virglnla, or any other applicable <br />local, State, or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building <br />permits or any other required permit will be issued only <br />upon compliance with the ordinances, laws, or <br />regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council <br />of the City of Portsmouth, Virginia, that the certain <br />Group H6using Project consisting of a four (4) unit <br />apartment building at the northeast corner of Hartford <br />Street and Douglas Avenue and designated as GHP-85-9, <br />and more specifically described in correspondence from <br />KlrK Berkley, A.I.A., dated March 6, 1985, as shown on <br />plans designated "Four Unit Condominium For McCurrin <br />Real Estate Trust" filed with the appropriate o'fficials <br />of the City of Portsmouth, Virginia, such being made a <br />part hereof, is hereby gra~ted approval subject to the <br />following terms and conditions: <br /> <br /> <br />
