AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTIONS 2-11 (a), 2-12 (a), (b), AND (f) AND SECTION 2-13 THEREOF, PERTAINING TO SICK LEAVE, ANNUAL LEAVE AND LEGAL HOLIDAYS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that Sections 2-11 (a), 2-12 (a), (b), and (f), and Section 2-13 of the Code of the City of Portsmouth, Virginia, 1973, be amended to read as follows: Section 2-11. Sick Leave. (a) There shall be granted to each full time regular officer and employee sick leave with pay at the rate of one (1) day of sick leave for each continuous calendar month of employment. The sick leave shall be accumulative without limitation. The City Manager or head of the division super- vising the employee shall, when he deems it advisable, require a certificate from a reputable physician as evidence of illness before compensation for a sick leave period is allowed, and the City Manager in his discretion may also require an examination by a reputable physician selected by him, whose decision as to the illness of the officer or employee shall be taken as final by the City Manager. Section 3-12. Annual Leave. (a) There shall be granted to each officer and employee of the City annual leave at the rate of'one (1) day annual leave for each continuous calendar month of employment. (b) In addition to the annual leave benefits provided in subsection (a) above, each officer and employee who shall have completed the specified number of calendar years of continuous employment shall be entitled to additional annual leave to be credited on their anniversary dates, in accordance with the following schedule: .YEARS OF EMPLOYMENT (ANNIVERSARy DATES) BONUS DAYS PER YEAR thru 4 years 2 thru 9 years 3 10 thru 14 years 5 15 thru 19 years 7 20 years and over 9 (f) The amount of annual leave to which any officer or em- ployee is granted may be accumulated and carried over from year to year; provided, however, that all accumulated unused annual leave in excess of forty-two (42) days of annual leave entitlement remaining in the leave account of the officer or employee as of December 31 of each year shall be automatically cancelled at the expiration of such year.
