1985-33 AN ORDINANCE TO AMEND ARTICLE VIII OF CHAPTER 23 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ADDING SECTION 23-516 THERETO PERTAINING TO BOAT REGISTRATION, FEE, ISSUANCE AND DISPLAY OF DECAL, PENALTY, ETC. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia, that Article VIII of Chapter 23 of the Code of the City of Portsmouth, Virginia, be amended by adding thereto Section 23-516 to read as follows: Section 23-516. Boat registration; fee; issuance and display of decal; penalty; etc. (a) For each year beginning with January 1st thereof and ending with December 31st following, until otherwise changed, there is hereby imposed and there shall be collected from every person owning a pleasure boat or watercraft used for recreational purposes only, which pleasure boat or watercraft is normally docked, stored or kept within the City limits or any waters within the territorial limits of the City, a registration fee of $10.00 for each such boat or watercraft. If the registration fee is not paid by January 31 of any year there shall be added thereto a penalty of 10% to be assessed and paid as a part thereof. (b) The Commissioner of the Revenue shall begin to assess and collect the registration fee imposed hereby on January 1 of each year and shall issue to each person paying such registration fee a decal or sticker which shall be permanently affixed and displayed on such boat or watercraft on the port bow thereof forward of the state identification numbers if such boat or watercraft is required to display identification numbers, or forward of the point where such identification numbers would be displayed. (c) No decal or sticker shall be issued unless and until the applicant for such decal or sticker shall have produced satisfactory evidence before the Commissioner of the Revenue that all personal property taxes upon such boat or watercraft have been paid which have been properly assessed or are assessable against the applicant by the City. (d) Any person who operates, or any owner who permits to be operated, on any waters within the territorial limits of the City such boat or watercraft without first procuring and displaying a decal or sticker as required herein shall be guilty of a misdemeanor and punished by fine of not more than $50.00.
