AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS AMENDED, BY AMENDING SECTION 40-109 AND <br />ORDAINING SECTION 40-126, PERTAINING TO ZONING. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-109 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and ~eordained to read <br />as follows: <br /> <br />Section 40-109. Appeals. <br /> <br /> Appeals may be taken from any action or decision of the <br />Commission in granting or refusing to grant a certificate of <br />appropriateness or permit pursuant to the provisions of this <br />article to the City Council for review, by setting forth in <br />writing ~he alleged error of the action or decision of the <br />Commission, provided such petition is filed within thirty <br />days after the final decision is rendered by the Commission. <br />The filing of the appeal shall stay the decision of the <br />Commission pending the outcome of the appeal, except that the <br />filing of the appeal shall not stay the decision of the <br />Commission if such decision denies the right to raze or <br />demolish a building o~ structure. <br /> <br /> Appeals may be taken from any such action or decision of <br />the City Council to the Circuit Court of the City of <br />Poutsmouth for ~evlew by filing a petition at law, setting <br />forth the alleged e~ror of the action or decision of the <br />City Council, provided such petition is fi~ed within thirty <br />days after the final decision is ~end'ered by the City <br />Council. The filing of said petition shall stay the decision <br />of the City Council pending the outcome of the appeal to the <br />Court, except that the filing of such petition shall not stay <br />the decision of the City Council if such decision denies the <br />right to raze or demolish a building or structure. <br /> <br /> 2. That Section 40-126 of the Code of the City of <br /> Portsmouth, Virginia, 1973, be ordained to read as follows: <br /> <br />Section 40-126. Appeals. <br /> <br /> Appeals may be taken from any action or decision of the <br />Design Committee in granting or ~efusing to grant a <br />certificate of compliance or a certificate of intent o~ <br />permit pursuant to the provisions of this article, to mhe <br />City Council for ~eview by setting forth in writing the <br />alleged error of the action or decision of the Design <br />Committee, provided such petition is filed within thirty days <br /> <br /> <br />
