AN ORDINANCE CONFIRMING THE DECLARATION OF A LOCAL <br />EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES (CITY <br />MANAGER), RATIFYING ALL ACTIONS TAKEN PURSUANT THERETO, <br />AND DECLARING A L6CAL EMERGENCY AND THE END THEREOF. <br /> <br /> WHEREAS, because of the threat anticipated from a <br />hurricane designated as "Gloria", which appeared to be <br />of unprecedented size and destructiveness occurring in <br />the evening of September 26, 1985 and continuing <br />thereafter into the morning hours of September 27, 1985: <br />and <br /> <br /> WHEREAS, because of the necessity for the <br />preservation of the public peace, health and safety, and <br />to p~eserve the lives and property and economic <br />well-being of the people of the City of Portsmouth, a <br />state of emergency had been declared by the Governor of <br />the Commonwealth and the local emergency declared by the <br />Director of Emergency Services (City Manager) of the <br />City of Portsmouth; and <br /> <br /> WHEREAS, the action of the local directo~ of <br /> emergency services (City Manager) of the City of <br /> Portsmouth being deemed by the Council to have been <br /> prudently undertaken must be confirmed by the Council <br /> and actions taken pursuant thereto ratified. <br /> <br /> BE IT ORDAINED by the <br />Portsmouth, Virginia: <br /> <br />Council of the City of <br />local emergency heretofore <br /> <br /> Section 1. That the <br />declared by the City Manager at 9:00 p. m. on Thursday, <br />September 26, 1985, acting as the local director of <br />emergency services in accordance with authority granted <br />in Chapter 3.2 of Title 44 of the Code of Virginia, <br />1950, as amended, is hereby confirmed. <br /> <br /> Section 2. That the local director of emergency <br />services (City Manager) is hereby authorized to exercise <br />in the name of the City all authority granted thereto by <br />Chapter 3.2 of Title 44 of the Code of virginia, 1950, <br />as amended, and in furtherance thereof, undertake such <br />actions as in his judgment are proper including, but not <br />limited to, action authorized by Section 44-146.21 of <br />the Code of VirginIa, 1950, as amended, and hereby <br />ratifies any such actions heretofore taken by him. <br /> <br /> Section 3. That the local emergency declared <br />hereby expired at 10:00 a. m. on Friday, September 27, <br />1985, as declared by the director of emergency services <br />(City Manager). <br /> <br /> <br />
