exists for more than a week in any river, creek, stream or <br />swamp, so as to obstruct the free passage of boats, canoes <br />or other floating vessels or fish in such waters. <br /> Whenever any vessel, barge, scow or other craft is <br />wrecked or sunk in any of the waters in the City, <br />accidentally or otherwise, the owner of such vessel, barge, <br />scowl or other craft shall immediately mark it with a buoy <br />and a lighted lantern at night, and maintain such markers <br />until such sunken craft shall have been removed, and it <br />shall be the responsibility of such person to immediately <br />remove the same and to prosecute such removal with <br />diligence. The neglect or failure of the owner to so make <br />and to remove the craft shall be unlawful. Each day such <br />craft or object remains abandoned and unmarked shall <br />constitute a separate violation of this section. <br /> <br /> Section 23-507.1. Removal or repair of hazardous or <br /> obstructing docks, wharves, piers, <br /> pilings, bulkheads or other structures <br /> or vessels. <br /> <br /> (a) Whenever the Director of Planning, EngineerIng and <br /> Inspections shall be of the opinion that any~'dock, wharf, <br /> pier, piling, bulkhead or other structure or vessel might <br /> endanger the public health or safety of persons, or might <br /> constitute a hazard or obstruction to the lawful use of the <br /> waters within or adjoining the City, he shall cause a <br /> written notice to be served upon the owner of s~ch dock, <br /> wharf, pier, piling, bulkhead or other structure or vessel <br /> or the land upon.which,same is situated, directing the owner <br /> to remove, repair or secure such ~uroperty within the time to <br /> be specified within such notice. Any such owner who shall <br /> fail to remove, repair or secure such property within the <br /> time specified in such notice shall be guilty of a Class I <br /> misdemeanor. <br /> <br /> (b) If the owner fails to remove, repair or secure <br /> such dock, wharf, pier, piling, bulkhead or other structure <br /> or vessel within the time specified in the notice given <br /> pursuant pursuant to this section, the Director of Planning, <br /> Engineering and Inspections or his agent may remove, repair <br /> or secure such property at the expense of the owner, and the <br /> expense shall be chargeable to and paid by the owner of such <br /> property. Such expense shall be a lien upon such property <br /> or upon any parcel of land of which it is a part or to which <br /> it is affixed or from which it was removed, until paid, and <br /> shall be reported by the Director of Planning, Engineering <br /> and Inspections to the City Treasurer, who shall collect the <br /> same in the manner in which City taxes levied upon the real <br /> estate are authorized to be collected. Such lien shall be <br /> ~ecorded in the Judgement Lien Docket Book in th~ Circuit <br /> Court of the City and may reduced to a personal judgement <br /> against the owner. <br /> <br /> <br />
