AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 40-284 THEREOF, PERTAINING <br />TO PROHIBITED SIGNS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-284 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended and reordained to read <br />as follows: <br /> <br />Section 40-284. Prohibited signs. <br /> <br /> Upon receipt of notice frora the building official or <br />his designee, the owner or occuoant of the property on which a <br />prohibited sign is located shall remove said sign within the <br />time specified in the notice. Upon the expiration of the <br />soecified time for removal, the building official or his <br />designee, in addition to any other available remedies, may <br />cause such prohibited sign to be removed, and any costs <br />incurred thereby shall be payable by the owner or occupant <br />of the property. <br /> <br /> For the purposes of this article, the following signs <br />shall be prohibited in the city: <br /> <br /> (1) Abandoned signs which no longer identify or advertzse <br />a bona fide business, lessor, service, owner, product or <br />activity located on the premises. Where the owner or lessor <br />of the premises is seeking a new tenant, such signs may <br />remain in place for not more than ninety (90) days from the <br />date of vacancy. An off-premises sign shall be deemed <br />"abandoned" if no copy or advertising matter is exhibited <br />on the advertising faces for more than sixty (60) calendar <br />days. <br /> <br /> (~2) Animated signs which utilize any form of involvement <br /> including, but not limited to, animation, revolution, vertical <br /> or horizontal motion, whether mechanical, electronic, windblown <br /> (powered) or wired except: <br /> <br /> (a) Revolving siqns located on a corner lot with <br /> no other sign except wall window; <br /> <br /> (b) Changing message signs which do not utilize <br />exposed light bulbs or any way produce glare to traffic; <br /> <br /> (c) Street clocks or time and/or temperature displays <br />when changes in lighting occur only to indicate the change in <br />time and/or temperature. <br /> <br /> <br />
