49 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OP THE CITY OF PORTS- <br />MOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING LOCATED <br />AT LONDON BOULEVARD AND MIDDLE STREET AND DESIGNATED AS GHP- <br />84-7. <br /> <br /> ~EREAS, Portsmouth Enterprises, Inc., by Dan E. Griffin, <br />Architect, has made application pursuant to Section 40-55 of <br />the Code of ~he City of Portsmouth, Virginia, 1973, as amended, <br />for the granting and approval of a group housing project con- <br />sisting of thirty (30) condominium units on a parcel of land <br />generally bounded by London Boulevard on the north, Middle <br />Street on the east, and Queen Street on the south, and con- <br />taining 1.18 acres and designated as GHP-84-7; and <br /> <br /> WHEREAS, the application has been de%ermined by the <br />P~anning Co~lmission to have met the requirements of §40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> ~EREAS, the Planning Commission has reviewed such appli- <br />cation and site plan submitted therewith, and has reco~ended <br />a conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that the approval <br />of a group housing project pursuant to ~40-55 grants only an <br />exemption from certain requirements for residences as stated <br />in said section, and does not constitute a waiver of any other <br />requirement embodied in the subdivision ordinance, zoning <br />ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal laws or regulations; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinance, la~s, and regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing project <br />designated as GHP-84-7, more specifically described in corres- <br />pondenoe from the applicant received by the Director of Planning, <br />and as shown on plans prepared by Dan E. Griffin and Kenneth <br />M. Sedlacko, Architects, for Portsmouth Enterprises, Inc. which <br />have been filed with the appropriate officials of the City of <br />Portsmouth, Virginia, such correspondence and plans being made <br />a part hereof, is hereby granted approval subject to the follo%~- <br />lng terms and conditions: <br /> <br /> <br />
