48 <br /> <br />A RESOLUTION GRA~NTtNG APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO §40-55 OF THE CODE OF THE CiTY OF PORTSMOUTh, <br />VIRGINIA, 1973, AS k~ENDED, SAID PROJECT BEING A 10 UNIT <br />CONDOMINIUM STRUCTURE CALLED VICTORIA SQUARE LOCATED AT <br />401-403 MARYkAND AVENUE AND DESIGNATED AS GHP-84-3. <br /> <br /> WHEREAS, Alton F. Catlett, has made application pursuant <br />to Section 40-55 of the Code of the City of Portsmouth, Virginia, <br />1973, as amended, for the granting and approval of a group <br />housing project consisting of a ten (10) unit condominium <br />structure at 401-403 Maryland Avenue; and <br /> <br /> WP/EREAS, the application has been determined by the <br />Planning Commission to have met the requirements of ~40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973t as <br />amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plans submitted therewith, and has recommended <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval <br />of the group housing project pursuant to said §40-55 grants <br />only an exemption from certain requirements for residences <br />as stated in said section, and does not constitute a waiver <br />of any requirement embodied in the subdivision ordinance, <br />zoning ordinance, the Code of the City of Portsmouth, or any <br />other applicable local, state or federal law or regulation; <br />and <br /> <br /> WHEREAS, the developer is aware that building permits <br />or any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the certain group housing <br />project known as Victoria Square consisting of a ten (10) <br />unit condominium structure to be constructed at 401-403 Maryland <br />Avenue and des±gnated as GHP-84-3, and more specifically <br />shown on plans entitled "Victoria Square", together with <br />correspondence dated January 1!, 1984 from Alton F. Catlett <br />to the Director of Planning, such plans and documents having <br />been filed with the appropriate officials of the City of <br />Portsmouth, Virginia, and made a part hereof, is hereby <br />granted approval. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia <br />at a meeting held May 22, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
