44 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A <br />LICENSE AGREEMENT WITH SEABOARD SYSTF~4 RAILROAD, !NC. FOR <br />INSTALLATION OF STO~ DRAINAGE PIPES. <br /> <br /> WHEREAS, the City of Portsmouth desires to make certain <br />drainage improvements for storm water drainage in the vicinity <br />of Airline Boulevard; and <br /> <br /> WHEREAS, a portion of the planned drainage work requires <br />the installation of concrete drainage pipes across the <br />property of Seaboard System Railroad~ Inc. in the vicinity <br />of Mile Post SA-4; and <br /> <br /> WHEREAS, Seaboard System Railroad, Inc. has agreed to <br />allo%~ the City to construct, maintain and renew said drainage <br />pipes. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the City Manager be, and <br />he hereby is, authorized to enter into an agreement With <br />Seaboard System Railroad, Inc. whereby said railroad grants <br />unto the City the right for license to install and maintain <br />reenforced concrete drainage pipes across the railroad's <br />right-of-way at or near Portsmouth, Virginia commencing at a <br />manhole located on the southeast side of the railroad's <br />track at a point 697.82 feet northeast of Mile Post SA-4. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia at a meeting held May 22, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
